By using this website or engaging Warisan for legal services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this website or engage our services.

Use of this website or engagement of our services constitutes an acknowledgement that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

Where Services are engaged on behalf of an estate or a company, the person instructing Warisan warrants that they have the authority to do so.

Warisan provides legal services related to inheritance matters in Malaysia. Our current services are:

The precise scope of any engagement will be set out in the engagement letter issued before work commences. Warisan will carry out only the work described in that letter unless the scope is formally varied in writing.

Warisan provides legal services to clients in Malaysia. This website does not constitute legal advice and does not create a solicitor-client relationship. A solicitor-client relationship arises only upon execution of a formal engagement letter.

4. Fees and Payment

The fees for each service are as stated in our fee schedule and confirmed in the engagement letter. All fees are denominated in Malaysian Ringgit (RM) and are subject to any applicable taxes.

Refunds, where applicable, will be addressed in the specific engagement letter for the matter concerned. General website use does not attract any fees.

5. Professional Obligations

All lawyers at Warisan are members of the Malaysian Bar and hold current practising certificates issued under the Legal Profession Act 1976. Our conduct is governed by the Legal Profession (Practice and Etiquette) Rules 1978 and the Solicitors' Accounts Rules.

Warisan maintains professional indemnity insurance as required by the Bar Council. Queries about our professional standing may be directed to the Malaysian Bar at www.malaysianbar.org.my.

To allow Warisan to carry out the Services effectively, you agree to:

Warisan accepts no liability for delays or adverse outcomes arising from a Client's failure to provide information or instructions in a timely manner.

7. Confidentiality

Warisan maintains strict confidentiality in relation to all client matters in accordance with its obligations as a law firm under the Legal Profession Act 1976 and the common law duty of confidentiality.

Confidential information will only be disclosed to third parties (including courts, registries, and institutions) where required to carry out the Services engaged, where required by law or court order, or with your express consent.

8. Intellectual Property

All content on this website — including text, layout, design, and code — is the property of Warisan and is protected by applicable intellectual property laws. You may view and print content from this website for personal, non-commercial use only.

Documents prepared by Warisan in the course of an engagement remain the property of Warisan until all fees are paid, after which the Client is provided with their copy. The underlying precedents and know-how used in preparing those documents remain the property of Warisan.

10. Limitation of Liability

Warisan's liability for any claim arising from the Services is limited to direct loss caused by our proven negligence. We do not accept liability for indirect, consequential, or incidental loss of any kind.

Where permitted by law, our aggregate liability in relation to any one matter is limited to the professional fees paid to Warisan for that specific matter.

Nothing in these terms limits liability for fraud, wilful misconduct, or any matter that cannot be excluded by law.

11. Termination of Engagement

Either party may terminate an engagement by written notice. Warisan may terminate an engagement if:

On termination, Warisan will provide the Client with their file and such information as is reasonably necessary to allow them to instruct another lawyer, subject to payment of outstanding fees.

12. Governing Law and Dispute Resolution

These Terms and Conditions and any engagement are governed by the laws of Malaysia. The courts of Malaysia have exclusive jurisdiction over any dispute arising from or relating to these terms or any engagement with Warisan.

In the event of a complaint or dispute about our Services, please write to us at [email protected] in the first instance. We will endeavour to respond and resolve the matter within fourteen (14) days.

Clients who are dissatisfied with Warisan's handling of a complaint may refer the matter to the Advocates and Solicitors Disciplinary Board or the Malaysian Bar.

Warisan may update these Terms from time to time. Updated terms will be posted on this website with a revised effective date. The terms applicable to a specific engagement are those in force at the date the engagement letter is signed.
